If you are caught in possession of an illegal substance, you may be charged with the possession of illegal drugs. If you are found to be in possession with the intent to supply, you will face far more severe consequences. For possession with intent to supply a class A drug, you could be facing life imprisonment, an unlimited fine, or both. The maximum sentence for possession with intent to supply Class B or C drugs is up to 14 years imprisonment or an unlimited fine. Several factors will be considered when sentencing for possession with the intent to sell including:

  • previous convictions;

  • amount of drugs in possession;

  • cooperation with the police and authorities;

  • personal drug habits.

What is the sentence for supplying drugs?

A conviction for possession with the intent to supply can result in substantial prison sentences and under the Proceeds of Crime Act. You may be made the subject of a Confiscation Order.

Prosecution of a Class A drug will result in a higher sentence and could result in life imprisonment, a fine, or in some cases both.

Prosecution for supply of Class B and C drugs can result in up to 14 years imprisonment, a fine, or in some cases both.

To be charged for drug supply, there does not need to be a transfer of money, simply giving a drug to a friend could amount to charges.

What is the sentence for importing illegal drugs?

For a drug related conviction, you will likely receive a lengthy prison sentence. When sentencing for the importation of illegal drugs, the Judge will look at any aggravating or mitigating factors which could increase or reduce a sentence. The Court will consider:

  • the quantity of drug imported

  • the class of drug

  • the purity of the drug

  • Was the drug(s) imported with the intention of being sold or for personal use?

  • What was the role of the accused?

Will my case be tried in the Crown Court?

All criminal cases start in the Magistrates Court but more serious offence are tried in the Crown Court. Due to the seriousness of the offence, the majority of cases involving drugs are tried in the Crown Court.

What is ‘conspiracy’ to supply/import drugs?

Conspiracy to supply or import drugs is an agreement between two or more people to either supply or import drugs. You don't have to be caught in possession of a drug or importing drugs to be prosecuted for conspiracy. The agreement to do so is the offence.
